Dharam Pal Yadav is a mafia don turned politician in India, the "unrivalled don of western Uttar Pradesh"[1]. He is currently a member of the Uttar Pradesh Legislative Assembly, from his own 2-member party, but was earlier associated with several parties including the Bharatiya Janata Party, Samajwadi Party, and Bahujan Samaj Party.

Before entering politics, D. P. Yadav had racked up nine murder charges, and was implicated in a bootlegged liquor sale which killed 350 people in the early 1990s[2]. Since 1989, he has served several terms as minister in the state government with Mulayam Singh Yadav. In 2004, he became a member of the Indian Parliament under the Bharatiya Janata Party but such was the ensuing scandal that the party threw him out within days. Most recently, he narrowly won the Uttar Pradesh assembly elections, 2007 from Sahaswan (margin of 0.1%[3]). Yadav's wife Umlesh Yadav, is also a state legislator, representing neighbouring Bisauli. The family's declared assets of Rs. 26 crores (USD 6 million) makes them the richest political family in Uttar Pradesh[4].

Criminal charges

Yadav entered the clandestine country liquor trade as a protégé of Mahendra Singh Bhatti, a criminal turned politician, in the late 1970. Bhatti was then the block pramukh in Ghaziabad. The first case was registered against him in 1979 in the Kavi Nagar police station of Ghaziabad. [5]

He has been charged in nine murder cases[6], three cases of attempted murder, two cases of dacoity, many cases of kidnapping for extortion, as well as various crimes under the Excise Act, Gangsters' Act, and even the Terrorist and Disruptive Activities Act. The cases were filed in the districts of Ghaziabad, Modinagar , Bulandshahr, Moradabad, Badayun , in western Uttar Pradesh, and in Jind and Sirsa districts in Haryana. In one of the cases filed against DP Yadav in Haryana in the early 1990s, illicit liquor supplied by him was responsible for the death of 350 people. [2] [5]

By 1991 after he had entered politics, he had some 25 criminal cases registered against him. During the BJP regime of chief minister Kalyan Singh, he was arrested under the National Security Act. In 1992 he was accused by the CBI of murdering his erstwhile mentor Mahendra Singh Bhatti, who was at the time MLA from Dadri[6]. This is one of the many unresolved cases pending against him.

Criminal Rating: B class history-sheeter

In the system used by the Indian Police called "history sheet", hardened criminals are rated A or B; A are those who have some potential for being reformed; B are the incorrigibles, and names from the B sheets cannot be expunged by later governments. D. P. Yadav is a B class history-sheeter. Since Yadav entered politics, the cases filed against him have fallen abruptly. Today his reputation is so established that the main business (extortion) proceeds smoothly without too much actual exercise of force.

Political career

In 1989, DP Yadav joined hands with Mulayam Singh Yadav, who offered him a candidacy from Bulandshahr under his Samajwadi Party. He won handily, and became the minister for Panchayati Raj.

In 2004, Atal Bihari Vajpayee who has an otherwise clean image, faced considerable criticism for having inducted DP Yadav into his Bharatiya Janata Party, under which Yadav served on Indian Parliament's house of elders, the Rajya Sabha. [2] Eventually, BJP terminated their relationship with DP Yadav after four days of media furore.

At the time, DP Yadav maintained that his image as a mafia don was completely fabricated, and the 25 cases against him do not mean much until concluded upon by the courts. [7]

In 2007, he formed the Rashtriya Parivartan Dal with his wife Umlesh Yadav. They were the only candidates, and both won in the Uttar Pradesh state assembly elections, 2007 - he from Sahaswan, she from Badaun.

Family

In 2001, DP Yadav's daughter Bharti Yadav fell in love with Nitish Katara, an executive in Delhi. DP Yadav apparently did not approve of him, and Bharti told Nitish's mother repeatedly of the dangers her son faced. Eventually, Nitish was murdered by DP Yadav's son Vikas Yadav on the night of February 17, 2002. In a confession to the police, which was aired by the NDTV channel in May 2006, [8] Vikas says:

"The affair was damaging my family's reputation. I never approved of their relationship. ... Using all my strength, I hit Nitish's head with a hammer. He fainted and after a while he died. We drove one kilometre and then we threw his body onto the road.
Then we took the diesel from our car's tank, poured it on Nitish's body and we set it on fire. Then we drove to Delhi. I can help the police to find the hammer I used. I can take them to the spot where Nitish was murdered.

Allegations of witness intimidation and Evidence tampering

In 2007, during the Vikas Yadav trial, a key witness Ajay stated:

If DP Yadav comes to know I am in hospital then he will get me killed here. He wants an affidavit regarding Nitish Katara murder case. I won't give it to him even if he kills me.[9]

In 2008, Vikas was convicted and sentenced to Life imprisonment by a court in Delhi on 30 May, 2008.[10] The court wrote that the murder had been committed because a love marriage would not be acceptable to the family:

It isn't digested by elder males of the family like brothers (in such sections of society) that a female exercises her right to choose a male partner of her own choice which often leads to shocking and macabre consequences.[11]

DP Yadav's name also figures in the Jessica Lal murder case, in which also Vikas Yadav was convicted of abetting the murderer, his friend Manu Sharma. In this case also, the investigating officer alleged that a key bullet cartridge had been exchanged in the Police Forensic Laboratory "at the behest of D.P. Yadav"[12]. However, Yadav denied the charge.
